2. Purpose and scope

This legal notice governs access to, browsing of and use of the Nexo Soft website, which provides information about its software products (Nexo ERP and Nexo WMS) and its implementation, support and digital marketing services for ecommerce, 3PL and fulfilment businesses.

Browsing the website confers the status of user and implies full acceptance of this legal notice, the privacy policy and the cookie policy. If you do not agree with their content, please refrain from using the website.

Contracting Nexo Soft's services is governed by the terms of service and by the proposal or contract signed with each client.

Communications made through these channels are deemed effective for all purposes.

4. Conditions of access and use

Access to the website is free of charge. Some services, such as requesting a demo or an audit, require you to provide data through a form. You warrant that the data you provide is accurate and up to date and are liable for any damage caused by its inaccuracy.

The website is aimed at professionals and businesses. Pursuant to Article 7 of Spanish Organic Law 3/2018 (LOPDGDD), persons under 14 must not provide personal data through it.

Users undertake to use the website lawfully and diligently and, in particular, must not:

5. Intellectual and industrial property

All website content (text, images, screenshots, graphics, logos, design, source code and software) is owned by Nexo Soft or by third parties who have authorised its use, and is protected by intellectual and industrial property law.

Nexo ERP, Nexo WMS, Nexo Soft and the other trade names, trademarks and distinctive signs on the website belong to Nexo Soft or their respective owners. Client logos are displayed with permission and belong to their owners.

Users may view the content and make temporary copies for personal use. Reproduction, distribution, public communication, transformation or any other form of exploitation without Nexo Soft's prior written authorisation is prohibited.

Simple links to the home page are permitted. Framing, deep linking or embedding website content in third-party pages in a way that misleads as to its origin is not permitted.

6. Exclusion of warranties and liability

Nexo Soft does not guarantee uninterrupted availability of the website or the absence of errors in its content, although it will take reasonable steps to correct them. The website content is for information purposes and does not constitute a binding contractual offer: the features, timelines and prices applicable to each client are set out in the corresponding proposal.

Nexo Soft is not liable for damage arising from website unavailability, the presence of viruses or other harmful elements, misuse of the content by users, or interruptions, delays or failures caused by factors beyond its control.

This exclusion does not affect the non-waivable rights granted to consumers by Spanish consumer protection law (Royal Legislative Decree 1/2007).

The website may include links to third-party pages, including the websites of clients shown as references. Nexo Soft does not control their content and accepts no liability for it; such links are provided for information only and do not imply any relationship with their owners.

If Nexo Soft becomes actually aware that the activity or information a link points to is unlawful, it will remove or disable the link diligently, in accordance with Article 17 of the LSSI-CE.

8. Personal data protection

Nexo Soft complies with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD). Personal data provided through the website forms is processed confidentially and as detailed in the privacy policy, which sets out the purposes, legal bases, retention periods, recipients and data subject rights.

Users may exercise their rights of access, rectification, erasure, restriction, objection and portability by writing to nexosoft.es@gmail.com and, where appropriate, lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).

The relationship between Nexo Soft and the user is governed by Spanish law. Any dispute will be submitted to the courts of Alicante (Spain), unless the user is a consumer, in which case the courts of the consumer's domicile will have jurisdiction, pursuant to Article 90.2 of Royal Legislative Decree 1/2007.
